VSim Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and AppNest Technologies LLC ("we", "us", or "our"), governing your access to and use of the VSim mobile application (the "App" or "Software") and related services (the "Service" or "Services").
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App or Services.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. We encourage you to review the Terms periodically for any updates.
2. Eligibility

Age Requirement: You must be at least 18 years old to use our Services. By using the App, you represent that you meet this age requirement. If you are under 18, you are not permitted to use the App or the Services.

Compliance with Laws: By using the App, you represent and warrant that your use complies with all applicable laws and regulations.
3. Access and Use of the Services

User Responsibilities: All users must comply with these Terms and all applicable laws and regulations, regardless of whether they log in or use the App without logging in.

Accountability: You are responsible for your actions and activities within the App.

Unauthorized Access: You agree to notify us immediately at info@vsim.app of any unauthorized access or use of your account or any other breach of security.
4. Description of Services
- Provision of Virtual Numbers: VSim provides virtual phone numbers for temporary use, allowing you to receive messages for verification and other purposes.
- Permitted Use: You agree to use the Services only for lawful purposes and in accordance with these Terms.
- Prohibited Activities: You agree not to use the Services for:
- Fraudulent or Illegal Activities
- Spamming or Unsolicited Communications
- Harassment or Abuse
- Interference with Services
- Unauthorized Access
4.1. Definitions

| Disposable Number | A Virtual Number intended for a single verification. |
| Credits | Pre‑paid, non‑refundable units of value that can be exchanged for Services within the App; they have no cash value outside VSim. |
| OTP (One‑Time Password) | A time‑sensitive code (numeric or alphanumeric) delivered via SMS for identity or transaction verification. |
| Fair Use | Reasonable, non‑abusive usage of the Services as defined in § 4.3; any use exceeding those limits is deemed unfair. |
4.2. One‑Time Use Guarantee
- Each Disposable Number is valid for one verification (i.e., a single SMS/OTP) only.
- After the first successful delivery, subsequent messages may be unsupported.
- The user bears full responsibility and forfeits any support or refund entitlement for attempts to reuse the same number.
4.3. Fair Use Policy
- Automation: Bulk or automated retrieval is prohibited unless performed through an approved API key issued by VSim.
- Penalties: Breach of Fair‑Use limits or unapproved automation may result in immediate account suspension/ban and revocation of unused credits without refund.
4.4. Suspicious Activity
- We will co‑operate with competent authorities and share relevant data when legally obliged to investigate fraud, spam, terrorism financing, or similar offenses.
4.5. Security & Data Storage

4.6. Consumer Rights & Refunds
- Credits Consumed = No Withdrawal: Once any amount of credit is spent, the statutory withdrawal right lapses.
4.7. Force Majeure
VSim is not liable for delays or failures caused by events beyond reasonable control, including but not limited to telecom or internet outages, war, sanctions, natural disasters, pandemic‑related disruptions, or coordinated DDoS attacks.
4.8. Severability & Entire Agreement
If any provision hereof is held invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and VSim regarding the Services and supersede all prior agreements.
4.9. Terms Update Process
- Notice: Material changes will be announced in‑app before taking effect.
4.10. Support Policy & SLA
- Response Time: We aim to respond to all support tickets within 24 business hours.
- Best‑Effort Delivery: SMS delivery depends on third‑party carriers; VSim provides a commercially reasonable effort but no strict SLA.
5. Purchases and Payments
a. Pricing and Fees
- Fees: While the App is free to install, users must purchase credits to buy virtual numbers and use the service. Pricing for numbers is dynamic and may change frequently. If you purchase credits for a number, the actual price at the time of activation may differ due to real-time updates. All prices are subject to change without notice.
b. Payment Methods
- Authorized Payments: By providing payment information, you represent and warrant that you are authorized to use the designated payment method for the specific purchase. You can buy packages at any time without any recurring charges or subscriptions.
c. Refund and Cancellation Policy

All Sales Final: All purchases are final and non-refundable. However, users may seek refunds through Apple or other third-party platforms if they qualify under those platforms' refund policies.

Refund Eligibility: If a purchased number fails to activate due to technical issues beyond the user’s control, users may request refunds via third-party platforms (e.g., Apple). We do not offer direct refunds, but refunds may be sought through the respective third-party platforms.

Account Suspension: We reserve the right to suspend or terminate your access to the Services if we determine that refund requests are being abused or misused. This includes cases where users initiate refunds through third-party platforms after successfully using the service.
6. Data Collection and Privacy
- Sharing Consumption Data with Apple: By using our services, you agree that we may share your consumption data, including purchase history and usage patterns, with Apple. This data sharing is conducted to enhance our service delivery and comply with Apple’s policies. We are committed to maintaining your privacy and ensuring the security of your information. The data will only be used for purposes directly related to improving your experience and facilitating refunds or related processes.

7. Intellectual Property Rights
a. Ownership of Content
- Our Content: All content, features, and functionality of the Services, including text, graphics, logos, and software, are the exclusive property of AppNest Technologies LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
b. License Grant to Users
- Limited License: We give you permission to use our App for personal, non-commercial purposes. This license is non-transferable and can be revoked at any time. You are not allowed to copy, sell, modify, or distribute any part of the App or its content.
c. Restrictions
- Prohibited Actions: You agree not to copy, modify, distribute, sell, or lease any part of the Services or Software, nor reverse engineer or attempt to extract the source code of the Software.
8. Disclaimers

As-Is Basis: We provide the Services "as-is" without any guarantees. There may be errors, downtimes, or other issues, and we do not guarantee that the Services will always be available or error-free.

Third-Party Services: We rely on third-party providers to offer certain functionalities. If these third parties stop providing their services, we cannot guarantee the continued availability of those features in our app.

No Warranties: We make no promises about the suitability of the app for your specific needs. There are no guarantees of uninterrupted service, security, or fitness for any particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, AppNest Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Services;
- Any conduct or content of any third party on the Services;
- Any unauthorized access, use, or alteration of your transmissions or content;
- Service interruptions, including downtimes or delays due to third-party providers.
- Restricted Jurisdictions: You may not access or use the Services if you are located in, a resident of, or accessing from the Russian Federation. Due to recent legislative changes, our Services are not available in Russia, and any attempt to use VSim from Russian IP addresses, payment methods, or locations is strictly prohibited.
10. Indemnification
You agree to indemnify and hold harmless AppNest Technologies LLC and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:
- Your access to or use of the Services;
- Your violation of these Terms;
- Your violation of any rights of another.
11. Termination
a. Termination by You
- Your Right to Terminate: You can stop using the app at any time and uninstall it if you no longer want to use the services.
b. Termination by VSim
- Our Right to Terminate: We may suspend or terminate your access to the app if we believe you’ve violated the Terms or for any other reason, at our discretion, without prior notice.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
13. Changes to Services
We reserve the right to modify or discontinue, temporarily or permanently, the Services or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of the Services.
